This is an application for condonation of delay of 31 days in filing Second Appeal.

Mr. Basale strenuously opposed this application and submitted that all the statements are concocted and no sufficient cause is made out.

Having regard to the fact that the delay is of 31 days, in the interest of

2/2 CAS/1193/2014 justice, Application deserves to be allowed so as to decide Appeal on merits rather than dismissing it on technical ground. Hence, Civil Application is allowed in terms of prayer clause (a) with no order as to costs. Office is directed to register Appeal, if it is otherwise ready.
