Feeling aggrieved by the order dated 30th April, 2019, passed in CC No. 4359/SS/2018, the Accused No. 3 therein, has fled this writ petition without exhausting the alternate remedy available in law. In consideration of this fact, the learned Counsel for the Petitioner, on instructions, seeks leave to withdraw the petition, with liberty to fle the appropriate proceeding to challenge the order dated 30th April, 2019. In case, the Petitioner fles such proceeding along with application seeking condonation of delay, the learned Court shall condone the delay, keeping in view the provisions of Section 14 of the Limitation Act.
