IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION CRIMINAL WRIT PETITION NO. 2857 OF 2017 Ramesh Shantilal Bataria ..Petitioner Vs.

State of Maharashtra and another ..Respondents Mr.Mohammed Umar Kazi, for the Petitioner, Mr.K.V.Saste - Addl.P.P., for Respondent State. CORAM : R. M. SAVANT, & SARANG V. KOTWAL, JJ DATE : 2nd MAY, 2018 P.C.

The writ jurisdiction of this Court is invoked to seek a direction against the Bazarpeth Police Station, Kalyan to deposit the demonetized currency notes with the Reserve Bank of India in terms of the order dated 27th March 2017. The time to deposit the said notes as stipulated by the Reserve Bank of India has expired long back. Any direction issued would be interfering with the policy decision of the Government as also the directions of the Reserve Bank of India. We are therefore unable to accede to the request of the Petitioner for deposit of the said notes in terms of the said order dated 27th March 2017 passed by the Learned Magistrate. The Writ Petition is accordingly dismissed.
