1) The learned counsel for the Applicants submits that application filed by present Applicants under Section 439 of Code of Criminal Procedure, 1973 was rejected by the Sessions Court on 11/07/2016. Application for bail was filed prior to filing of the charge-sheet. Hence, he seeks liberty to withdraw the application with further liberty to approach the Sessions Court under section 439 of Code of Criminal Procedure, 1973 in changed circumstances. 2) Liberty as prayed for is granted in the interest of justice. The learned Sessions Court shall consider the application, on its on merits, without being influenced by the withdrawal of this application. 3) Application stands dismissed as withdrawn.
