Heard the learned Counsel for the parties.

This is an application for pre-arrest bail in connection with C.R.No.366 of 2023 registered with Pantanagar Police Station for the offences punishable under Section 406, 420 of the Indian Penal Code, 1860. 3.

The Applicant allegedly induced the first informant to part with a sum of Rs.1,91,344/- by making a representation that the applicant would book the hotels at Maldives. However, the applicant returned a sum of Rs.71,000/- and duped the first informant of an amount of Rs.1,20,344/-.

On the previous date, a statement was made that the applicant would pay the balance amount of Rs.1,20,344/- to the first informant. 5.

The learned Counsel for the Applicant submits that the matter has been SSP 1/2

8 aba 1984 of 2023.doc amicably settled and a demand draft in the sum of Rs.1,20,344/- is handed over to the first informant, who is present in Court.

Consent Terms are tendered. The first informant / Respondent No.2 states that he has received the demand draft. The first informant is identified by the Investigating Officer. The Consent Terms are taken on record. 7.

In view of the aforesaid development, further interrogation of the applicant does not seem warranted.

Hence, the application stands allowed.

In the event of arrest of the Applicant - Abhishek Surendra Kotwal in connection with C.R.No.366 of 2023 registered with Pantanagar Police Station, the Applicant be released on bail on furnishing a PR bond in the sum of Rs.30,000/- with one or two sureties in the like amount.
