The applicant is seeking modification of the order dated 17th February, 2016 passed by this Court whereby the Writ Petition preferred by the applicant came to be dismissed. The petition was preferred against the order of Maharashtra Administrative Tribunal, Mumbai, dated 15/6/2015 thereby the Tribunal dismissed the O.A. preferred by the petitioner whereby the applicant has sought an appointment on compassionate basis.

Learned Counsel for the petitioner submitted that when the petitioner attained the age of 18 years he could have been appointed in Class-IV post. Hence, he seeks modification that the authorities to consider the applicant for appointment on compassionate basis to Class-IV post. The record shows that the applicant had applied only for the post of 'Agriculture Assistant' and not for Class-IV post. Moreover, the applicant preferred an application for appointment on compassionate basis on 30/7/2009 by which time it was much past the prescribed period for making an application for appointment on 2/3
compassionate basis. Looking to the facts and circumstances of the matter, it is not possible to modify the order dated 17th February, 2016, hence, the application is rejected. (M.S.KARNIK, J.) (ACTING CHIEF JUSTICE) 3/3
