Office noting shows that as spare copy was not supplied by the Advocate for the Applicants within stipulated time, notice could not be issued to the Respondent No.2.

Learned counsel for the Applicants undertakes to supply a spare copy in the Registry, on or before 26.08.2016, so as to enable the Registry to issue notice to the Respondent No.2.

If the spare copy is supplied within the stipulated time, notice be issued to Respondent No.2, returnable on 13.09.2016.

Learned APP waives notice on behalf of the Respondent No.1 - State. In addition to Court notice, Advocate for the Applicants, to serve the Respondent No.2 by Advocate's notice and file an Affidavit of service before the returnable date.

It is made clear, that if the spare copy is not supplied in the Registry, within the stipulated time, the Application shall stand dismissed for non-prosecution without further reference to the Court.
