By this civil application, the applicant seeks modification of the order dated 2nd July 2018 by which this Court had fixed two dates for the purpose of cross-examination i.e.23rd August 2018 and 24th August 2018.

Learned counsel for the applicant states that his client would remain present on 29th August 2018 and not on 23rd August 2018 and 24th August 2018. Learned counsel appearing for the respondent no.1 vehemently opposes this application on the ground that on several occasions, the applicant had applied for modification of the schedule. The respondent no.1 has engaged a senior advocate who had already blocked the dates as per schedule and thus any further change in the schedule is not possible.

This Court has shown enough indulgence from time to time to the applicant. In view of the strong objection raised by the respondent no.1, no further indulgence can be shown to the applicant. If the applicant chooses to remain absent on 23rd August 2018 and 24th August 2018, consequence provided in the order dated 19th June 2018 to follow. 5.

Civil application is accordingly dismissed. No order as to costs.
