Heard learned Counsel for the parties.

After the matter is heard at some length, it is agreed between the parties that the writ petition may be disposed of in terms of the following order. It is ordered accordingly as follows : (i) The Petitioner does not press his complaint, being Complaint (ULP) No.156 of 2017; the complaint stands withdrawn ;

(ii) The Register of the Labour Court at Pune be informed accordingly ;

22. WP 7429-18.doc (iii) The Petitioner shall file a reply to the showcause notice issued to him on 25 October 2017 by the Respondent within a period of two weeks from today ; (iv) Such reply shall be considered by the Respondent on its own merits ;

(v) In the meantime, till the reply is considered and final order is passed by the Respondent, and four weeks thereafter in case the order is against the Petitioner, the Respondent shall not take steps to terminate the Petitioner's service ;

(vi) All rights and contentions of the parties on merits are kept open ;

(vii) The writ petition is disposed of.
