This is an application for modification of order dated 27th April 2018 passed by this Court in Criminal Application No.724 of 2018. 2.

While suspending sentence and grant of bail, this Court had directed the applicant to attend Trial Court on every first Monday of the month.

Learned advocate for applicant submitted that since 2018 the applicant has been complying the said order. There is hardship in attending Trial Court every Monday. The applicant may be permitted to attend Trial Court once in six months.

Learned advocate for respondent no.1 submitted that condition of attendance at the most be relaxed by directing the

The appeal preferred by applicant-appellant is pending in this Court. Condition of attending the Trial Court once in month is complied from 2018. Hence, relief as sought in this application can be granted by modifying the order as follows :

ORDER

(i) Interim Application is allowed and disposed of; (ii) The order dated 27th April 2018 passed by this Court in Criminal Application No.724 of 2018 is modified by directing the applicant to attend and mark his presence before Trial Court once in six months on first Saturday of the month between 11 am and 2 pm till further orders;

(iii) Interim Application stands disposed of. (PRAKASH D. NAIK, J.) MST
