1) This is an application under Section 438 of the Cr.P.C. for pre-arrest bail in CR No.70 of 2016 dated 30.5.2016 registered with CBD Police Station, Navi Mumbai, District Thane under Section 381 of the Indian Penal Code.
2) The first informant Deepak Rupchand Baid is the husband of the applicant. In the first information report it is stated that on 30.5.2016 he realized that the hard disk and pen-drive kept in his office bag were stole by somebody. After verifying the CC TV footage, it was revealed that accused Ravi Parikh who was working with the complainant had come to the house of the complainant in his absence. In the premise, the first information report

3) During the course of the investigation, the police arrested Mr. Nikunj Bhat who is the brother of the applicant. The record discloses that there is a matrimonial discord between the applicant and her husbandcomplainant Mr. Deepak Baid. The applicant/wife of the complainant, left the matrimonial premises on 6.12.2015 and the present FIR is lodged against the accused on 30.5.2016. The police have already arrested the principal accused Ravi Parikh who has actually committed the theft and the co-accused Nikunj Bhat. They have been throughly interrogated. It prima facie appears that the applicant has no role to play in the crime. It prima facie appears that, only with a view to involve her in the crime and to take undue advantage of the situation, the present complaint is lodged. In view of the above, the custodial interrogation of the applicant is not at all necessary.
Hence, the following order.
a) In the event of arrest of the applicant in CR No.70/2016 registered with CBD Police Station, Navi Mumbai, Dist.Thane, she shall be released on bail on her furnishing PR bond of Rs.10,000/- with one or two sureties in the like amount.
b) Application is allowed in the aforesaid terms. (A.S.GADKARI, J.)
