1] This is an application for modification of condition which was imposed by the order dated 1st December 2010 by this Court in Criminal Application No.600 of 2010. On an application made by the applicant on earlier occasion for modification of the order, this Court by an order dated 1st December 2010 in Criminal Application No.600 of 2010 modified the earlier condition which was imposed, that the applicant shall attend concerned police station on every Saturday from 8.00 p.m. to 9.00 p.m., was relaxed and the applicant was directed to attend the concerned EOW on first Saturday of every month between 8.00 p.m. and 9.00 p.m.
YBG appp520-14 2] Learned Counsel for the applicant submits that the applicant is a bank employee and first Saturday being working day it is difficult now for him to mark his presence. The record discloses that on earlier two occasions at the instance of the applicant, the order of attendance came to be modified. Even if first Saturday is working Saturday, at the request of the applicant himself, time of 8.00 p.m. to 9.00 p.m. was incorporated in the order. The applicant is staying at Ulhasnagar and he has to attend EOW at Thane. 3] Even after taking into consideration the time for commuting the time stipulated in the said order is after the office hours are over. Accordingly, the order needs no interference. Application is dismissed.
