Heard Mr. Karande, learned Counsel for the petitioners and Ms. Badadare, learned Counsel for respondent No.8. 2.
The Contempt Petition was heard on 9th July, 2018. Mr. Nagvekar had filed Affidavit dated 9th July, 2018 of 8th respondent stating therein that respondent No.8 has vacated the suit premises on 2nd July, 2018 and that he handed over keys to the petitioner. Receipt of the keys of the suit premises was also acknowledged by the petitioner.

In view thereof, matter was ordered to be listed today for reporting compliance.

Mr. Karande has tendered possession receipt signed by petitioner No.2 setting out therein that he visited the suit premises and inspected the
904-wp-cp-299-2017.odt same and found to be vacant. He also acknowledged receipt of vacant possession of the suit premises. The same is taken on record and marked 'A' for identification. Mr. Karande submitted that as per clause (iv) of paragraph 14, of the order, the respondents herein have not paid arrears of rent. He also invited my attention to clause (6) of the undertakings filed by the respondents. Ms. Badadare, upon taking instructions from respondent No.8 assures that the respondent will pay arrears of rent to the petitioners up to 30th June, 2018 within two weeks from today. Statement on instructions made by Ms. Badadare is accepted.

As possession is handed over, Contempt Petition is disposed of. The respondents shall pay arrears of rent up to 30th June, 2018 within two weeks from today. List the Contempt Petition for reporting compliance on 7th August, 2018.
