The applicant is seeking pre-arrest bail in Crime No.236 of 2016 registered with non-applicant for the offences punishable under sections 420, 506 r/w. 34 of the I.P.C.

The other co-accused viz; Abhishek Tiwari, who claims to be proprietor of tax solution, financial company, was released on regular bail by the learned Sessions Judge vide order dated 29.07.2016 will speaks of the owing of entire liability of the complainant by said accused. The present applicant is shown as one of the co-accused and the only attribution against him in the entire proceeding is that the applicant had a conference hall with complainant and the accused Abishek Tiwari.

4.ABA.1292.16.doc Apart from above, there is hardly any material to connect the applicant to the crime in question.

In view thereof, application needs to be allowed. The applicant be released on bail on executing P.R. Bond of Rs.50,000/- with one surety in the like amount. The applicant shall attend police station on Monday and Thursday between 10.00 a.m. to 12.00 noon in the next week and thereafter as and when called. The applicant shall not tamper with the evidence or influence the witnesses.
