Heard Mr.S.G. Deshmukh, learned Counsel for the petitioner and Mr.Anilkumar Patil, learned Counsel for respondents No.1 & 2.

Mr.Deshmukh submitted that despite sending several letters to the petitioner, he is not responding to those letters. He submitted that perhaps in view of condition of the suit premises, the petitioner is not interested in prosecuting the Petition.

Mr. Anilkumar Patil has placed on record

It seems that the petitioner is not interested in prosecuting the Petition more particularly having regard to the condition of the suit premises. Perhaps the petitioner may have left the suit premises. In view thereof, the Petition is dismissed in default. Rule is discharged with no order as to costs. Interim order stands vacated.
