Learned counsel appearing for the parties submitted that the grievance raised in the instant petition is identical to grievance raised in Writ Petition No. 9007 of 2017, decided by the Division Bench of this Court on 11th September, 2017. For the reasons recorded in the aforesaid writ petition, instant petition deserves to be allowed by granting identical relief. 2.

The learned counsel appearing for the Petitioner is willing to give an undertaking as provided in the various orders 1 / 3

passed by this Court. Hence, we dispose of this petition by passing following order:

(a) The vehicle, subject matter of this petition, shall be released to the Petitioner subject to the condition of - (i) the Petitioner filing an undertaking before this Court to the effect that the vehicle shall not be plied in the city of Mubai and shall be taken out of the limits of City of Mumbai; and (ii) the Petitioner in this petition depositing a sum of Rs. 10,000/- (Rupees ten thousand only) with the concerned Regional Transport Office.

(b) Only upon the deposit of sum of Rs. 10,000/- (Rupees ten thousand only) by the Petitioner with the concerned Regional Transport Office and on the Petitioner producing true copy of the undertaking filed in this Court, the vehicle shall be released to the Petitioner on production of an authenticated copy of this order.

(c) Writ petition is disposed of in the above terms. (d) All concerned to act on an authenticated copy of this order.
