Learned counsel appearing for the Petitioner submitted that, the Petitioner and the Respondent No.1 have settled the matter amicably and have entered into 'Consent Terms' dated 18th August 2021. He further submitted that, the Respondent No.2 was not a party respondent before the Competent Authority, where the proceedings initiated by the Respondent No.1 under Section 24 of the Maharashtra Rent Control Act. He further submitted that, Clause No.7 of Consent Terms specifically provides that, the present Consent Terms are not binding on Respondent No.2.
He tendered across the bar original copies of Consent Terms dated 18th August 2021. The said Consent Terms are signed by the Petitioner and the Respondent No.1 and their signatures have been identified by their 1/2
Osk 20-WP-7702-2019.odt respective Advocates. The Consent Terms are taken on record and marked ' X'
for identification.
Photocopy of Memorandum of Understanding dated 31st July 2021 is also annexed to the said Consent Terms and are forms an integral part of the said Consent Terms dated 18th August 2021. 2.
In view of the fact that, the Petitioner and the Respondent No.1 have settled the matter amicably by executing 'Consent Terms' dated 18th August 2021, nothing survives in the present Petition and is accordingly disposed off.
