Heard learned counsel for the applicant in this repeated bail application. Also heard learned APP for the State. 2.

Earlier bail application no.675 of 2015 was heard at length on 08th May 2015 by this Court. When after prolonged hearing this Court started dictating the order mentioning that it was not a case for grant of bail, the learned counsel for the applicant prayed for withdrawal and accordingly the application was allowed to be withdrawn and accordingly disposed of by order dated 08th May 2015.

Present application is preferred on the changed circumstances. Apparently the only changed circumstance N.S. Kamble page 1 of 2

1-ba-1476-2015 according to the applicant is grant of bail to the co-accused in another application no.801 of 2015 by another bench of this Court on 14th July 2015. Needless to mention that the role attributed to the different accused is different, hence there cannot be parity claimed on the ground that other co-accused have been granted bail by the Court.

In the present case the material as against the present applicant was already ascertain and the Court indicated that this is not a case for grant of bail during the trial. Moreover the present applicant has been identified in identification pared and infact that aspect was also argued on earlier date. As such there is nothing to apprise the material as against the present applicant prima-facie available in the chargesheet. As such the present application is dismissed and accordingly disposed of.
