A request is made for modification of order dated 25th July 2022.

The learned Counsel for the Applicant submits that this Court has clamped an injunction against the Applicant from alienating or creating third party interest. Charge has been created of the amount as detailed in paragraph (c) and (d) of the order. the learned Counsel further submits that the Applicant would not be in a position to deal with the property.

The learned Counsel for the Applicant submits that, without prejudice to the rights and contentions of the Applicant, the Applicant would deposit the amount of Rs.31,37,113/- towards the differential premium and Rs.2,630/- towards process fees and GST in this Court.

Mr. Milind Sathe, the learned Senior Advocate for Respondent Nos.2 to 4 does not have objection to the said proposition. In light of the above, the operative part of the order dated 25th July 2022 is modified.

The operative part of order dated 25th July 2022 is recalled and substituted as under:

ORDER

a.

The Applicant shall deposit an amount of Rs.31,37,113/- towards differential premium and Rs.2,630/- towards process fees and GST in this Court.

b.

The said deposit shall be without prejudice to the rights and contention of either parties and subject to the decision in the Writ Petition.

c.

Upon deposit of the said amount in this Court, Respondent No.2 and 3 shall transfer the writ plot in the name of the Petitioner within 2/3

a period of one month from the date of the deposit. d.

Order dated 25th July 2022 is modified accordingly. e.

The Interim Application stands disposed of.
