The learned counsel for the Petitioner accepts that the Petitioner has a remedy of Appeal. However, submits that order was passed on the basis of the order of High Court. 2.

There was no order of the High Court, only reference is made of withdrawal of the Writ Petition.

As it is accepted that against the impugned order Appeal is tenable, we refrain from exercising our writ jurisdiction. The Petitioner may prefer an Appeal permissible in law.
