Heard learned counsel for the applicant and learned APP. 2.
This is an application for suspension of the sentence during the pendency of the appeal. The applicant was convicted by the trial Court for the offence punishable under section 354 of the Indian Penal Code, 1860 and sections 7 & 8 of Protection of Children from Sexual Offences Act, 2012 and sentenced to suffer rigorous imprisonment for 3 years. The applicant was on bail during the trial and thereafter till appeal period is over. The fine amount is paid. There is nothing on record to indicate that the applicant has misused 1/2

10. ia 2737.23.doc the liberty while he was on bail. The appeal is likely to take a long time to be heard finally as per its turn. I am therefore inclined to suspend the sentence and enlarge the applicant on bail. The sentence awarded by the trial Court by judgment and order dated 16/06/2023 to stand suspended during the penedency of the trial. 3.
The applicant is enlarged on bail on furnishing P.R. bond to the extent of Rs 25,000/- with one or more sureties of the like amount. 4.
On being released on bail, the applicant shall furnish his contact number and residential address to the investigating officer and shall keep him updated, if there is any change. 5.
The applicant shall remain present when the matter is heard. 6.
The application is disposed of.
