Considering the submissions made by the learned counsel for the Applicant I am satisfied that the Applicant has made out a case for allowing the Civil Application.

Hence, following order is passed:

a.

The Applicant is permitted to delete the name of Respondent from the cause title of the Second Appeal on or before 19.01.2018.

b.

If amendment is carried out within stipulated time as stated hereinabove, the Applicant to provide amended copy of the Second Appeal to the other side immediately thereafter.

c.

Civil application stands disposed off accordingly.
