Heard the learned Advocates for the parties and by consent, the following order is passed :

(i) Hindu Marriage Petition No.413 of 2016 filed by the Respondent before the Civil Judge, Senior Division, Panvel, Raigad, seeking dissolution of marriage with the Applicant stands transferred to the 5th Family Court at Bandra, Mumbai, to be heard along with Petition seeking restitution of conjugal rights filed by the Applicant before the same Court being Petition No.A-3100 of 2016. (ii)The Superintendent, Civil Court, Senior Division, Panvel, Dist. Raigad, shall transfer papers and proceedings in H.M.P.No.413 of 2016 to the Court of 5th Family Court, Bandra, Mumbai, on or before 4th September, 2017. ssp 1/2

mca 232 of 2017 (2).sxw (iii)The parties and their Advocate shall appear before the 5th Family Court Judge at Bandra, Mumbai on 13th September, 2017 at 11.00 a.m. and obtain necessary directions.

(iv)The learned Judge presiding over the 5th Family Court, Bandra, Mumbai, shall dispose off both the aforesaid Petitions filed by the Applicant and Respondent within a period of six months from 13th September, 2017 and shall not grant any adjournments to the parties unless absolutely necessary. (v) The Applicant shall be allowed to file her Written Statement and both the parties shall be allowed to lead their respective evidence. (vi)All contentions of the parties are kept open.
