Though respondent no.2 is duly served, no one appeared on behalf of them when the matter was called out.
This application is preferred by claimant for condonation of 122 days delay in filing First Appeal challenging the judgment and award dated 20.12.2012 passed by Commissioner for Employees Compensation and Judge, 5th Labour Court, Mumbai in Application (WCA) No.457/C132 of 2010. Considering the submissions made by the learned counsel for the Applicant and the Mohite 1/2
2 caf3592-13.doc averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application. Hence, the following order:
A) Civil Application is allowed in terms of prayer clause (a) which read thus:
"(a) that the delay of about 122 days in filing of the First Appeal may be condoned by this Hon'ble court."
