1] On expressing my disinclination to entertain the application in the wake of material compiled in the charge-sheet, the learned counsel for Applicant seeks permission to withdraw the application. 2] However, the learned counsel for the Intervenor i.e. mother of the victim, who also sought intervention, seek release of her husband on bail and according to her case appears to be concocted. 1/2

(32)BA-3340-2021.doc 3] I am not convinced with this submission, as the statement of the victim under Section 161 of the Cr.P.C. is corroborated by statement under Section 164 of the Cr.P.C. and veracity and authenticity of the prosecution case shall be determined during the course of trial. Hence, I deem it appropriate to grant permission to withdraw the Application.

4] However, since it can be seen that the Applicant came to be arrested in the year 2021 and more than one year has expired since his arrest, and charge being framed, the learned Special Court is requested to make every endeavour to expeditiously conclude the trial. 5] Before parting, I would also like to place on record appreciation for Mr.Anand Shalgaonkar, who was appointed by the legal services authority to represent the complainant and who has rendered assistance effectively. The Legal Services Authority shall make payment of remuneration, due and payable to him, within a period of four weeks from today.

6] Bail Application is disposed off as withdrawn. Interim Application is also disposed off.
