The order refusing stay in the Revision Application filed by the Petitioners against the demand notice issued pursuant to the adjudication under Section 88 of the Maharashtra Co-operative Societies Act (for short the said Act), is taken exception to by way of the above Petition. It is required to be noted that against the order passed under Section 88 of the said Act, the Petitioners have filed Revision Applications separately being Revision Application No.278 of 2013 relating to the Petitioner No.1 and the Revision Application No.7 of 2014 relating to the Petitioner No.2. The demand notice has been issued pursuant to the said order passed under Section 88 of the said Act. Hence it would be just and proper that the Revision Applications filed against the order passed under Section 88 of the said Act, are mmj

wp-7852-15-(911) decided in the first instance as the result of the said Revision Applications would undoubtedly have an effect on the adjudication of the Revision Application filed against the demand notice.

The Learned AGP Mrs. Nimbalkar states that the Revision Applications would be heard and decide by the Divisional Joint Registrar, Pune within 3 months from date.

In my view, it would be just and proper if the two Revision Applications i.e. Revision Application No.278 of 2013 and Revision Application No.7 of 2014, are decided within two months of 20-8-2015, on which day the parties are directed to appear before the Divisional Joint Registrar, Pune. In the light of the directions issued, it is not necessary to issue notice to the Respondent No.2 society.

With the aforesaid directions, the Writ Petition is disposed of. Till the decision is rendered in the Revision Applications, no precipitative steps to be taken pursuant to the order passed under Section 88 of the said Act. [R.M.SAVANT, J] mmj
