The above Petition takes exception to the order dated 25-1-2000 passed by the Collector, Thane, disqualifying the Petitioner under the provisions of the Maharashtra Local Authorities Members Disqualification Act, 1986. The said disqualification is under Section 3(1) of the said Act. The said disqualification is on the ground that the Petitioner as a member of the Jawahar Municipal Council had defied the whip of the house leader of the Congress party for the elections to the post of the President of the Jawahar Municipal Council which was held on 29-12-1999. The impugned order discloses that the Petitioner has only been disqualified and no other consequences have been mentioned in the impugned order. Since the elections of the President were held in December 1999 and since thereafter numerous elections to the Jawahar Municipal Council might have been held, the above mmj
