1. This is an application under Section 407 of the Cr.P.C. filed on behalf of the State seeking transfer of Sessions Case No.103 of 2012 from the Court of Sessions, Sangli to the Court of Sessions, Satara since the offence is stated to have been committed within the jurisdiction of Satara District. The original accused-respondent is also stated to be a resident of Satara. Notice was issued pursuant to order dated 10 th August, 2016 and was served through Miraj City Police Station. Advocate Mr. Joshi has also entered appearance on behalf of respondent no.1 on 8 th September, 2016.

Thereafter on 5 th January, 2017 when the matter was listed, the applicant was represented by the respondent and his Advocate was absent. Even today none appears for the respondent. In the circumstances, I pass the following order:- (i) Sessions Case No.103 of 2012 presently on the file of the Court of 1/2

33.appln-459.16.doc Sangli shall transferred with immediate effect to the Court of Sessions Judge, Satara.

(ii) Record and proceedings shall be transferred to the Court of Sessions, Satara.

(iii) Application is disposed of in the above terms. (iv) No order as to costs.
