Mr.Sanglikar learned counsel appearing for the applicant states that his client has no objection if the applicant is impleaded as the respondent without prejudice to the rights and contentions of his client that he should be impleaded as the appellant in place of the original appellant, who has expired. Statement is accepted. The appellant who is already impleaded as the appellant in place of the original appellant is directed to implead the applicant in the Civil Application No.3967 of 2013 as the respondent no.2. The amendment to be carried out without within four weeks from today. It is made clear that impleadment of the applicant as the respondent no.2 in the First Appeal No.649 of 1997 shall be without prejudice to the rights and contentions of the contesting respondent i.e. Dhirajlal R. Chheda.
