By this First Appeal, the Appellant insurance company is challenging the Judgment and award dated 16th June, 2014 passed by the Motor Accident Claims Tribunal, Pune in Motor Accident Claim Petition No. 331/2006 holding that the Respondents/Original Claimants are entitled to sum of Rs. 7,26,000/- by way compensation with interest @ 8% p.a.

The Learned Counsel for the Appellant submits that, he has received instructions from his client to withdraw the present First Appeal as well as pending Laxmi Sontakke

505 FA 242-17 Civil Applications. To that effect he has given in writing. The same is taken on record and marked as 'X' for identification. The same is accepted. 4.

Hence, the following order is passed:

a.

The First Appeal as well as pending Civil Applications stand disposed of as withdrawn.

b.

If any amount is deposited by the Appellant insurance company in the Registry of this Court then that amount to be transferred to the Motor Accident Claims Tribunal, Pune in the account of Motor Accident Claim Petition No.331 of 2006.

c.

Liberty is granted to the Appellant to move an appropriate application before the Tribunal for withdrawal of the said amount. d.

Refund Court fees as per rule.
