Mr. Marathe fairly invited my attention to the order dated 31.8.2017 passed by this Court. At the request of learned Counsel for the petitioner, the matter was adjourned to 1.9.2017 for withdrawal of the petition.

Mr. Marathe states that he has instructions to withdraw the petition. On the motion made by Mr. Marathe, Petition is allowed to be withdrawn and is disposed of accordingly. Mr. Marathe states that the petitioner will consider adopting appropriate proceedings. Statement made by Mr. Marathe is recorded. All contentions of the respondents including maintainability of the proposed proceedings are expressly kept open. In view of disposal of the Petition, Civil Application Nos.2148/2015 & 2149/2015 do not survive and the same are disposed of. Order accordingly.
