The applicant's two previous applications for bail have been rejected by me (Bail Application No.866 of 2014, decided on 16th June 2014 and Bail Application No.951 of 2015, decided on 11th June 2015). By this application, the prayer for bail is renewed only on the ground that the applicant is in custody for a period of about 20 months, and that, the trial has not yet commenced.

3-BA-1484-2015.doc It was already observed by me that there exists a prima facie case of an offence punishable under Section 302 of the IPC against the applicant. The learned counsel for the applicant fairly concedes that there is no change in the circumstances except that the applicant has remained in custody for a long time as an under trial prisoner and that the trial has not yet commenced. On carefully considering the matter, I am of the opinion that the applicant should not be released on bail. At the same time, it needs to be ensured that the trial is expeditiously held.

The application is rejected.

However, the trial court is directed to expedite the trial and complete it within a period of six months from the date of receipt of this order by it.

Liberty to the applicant to apply afresh for bail, in the event of the trial not being over within the stipulated period. (ABHAY M. THIPSAY, J.) avk 2/2
