This is an application under Section 439 of Code of Criminal Procedure for bail.

The applicant came to be arrested in Crime No.20 of 2022 registered at Alankar Police Station, Pune for the ofences punishable under Sections 376 (3), 363, 366(a), 323, 504 of the Indian Penal Code and Section 6, 17 and 21 of the Protection of Children From Sexual Ofences Act, 2012 (POSCO Act). 3.
I have heard the learned counsel for the applicant and the learned APP for the respondent - State and the learned counsel for respondent No.2.

I have perused the statement of prosecutrix. The case appears to be of love afair. It appears that the parents of the prosecutrix were not in favour of marriage of the prosecutrix with Dinesh S. Sherla 1/2
44-ba-2321-22.doc the applicant. They thus eloped and got married. Considering the overall facts and circumstances of the case, I am inclined to release the applicant on bail. In the result, the following order is passed.
O R D E R
A] Bail Application is allowed.
B] The applicant be released on bail in C.R. No. 20 of 2022 registered at Alankar Police Station, Pune for the ofences punishable under Sections 376 (3), 363, 366(a), 323, 504 of the Indian Penal Code and Section 6, 17 and 21 of the Protection of Children From Sexual Ofences Act, 2012 (POSCO Act) on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.
