Heard learned counsel for the parties.

It is not in dispute that the Petitioner has filed an Appeal before the Hon'ble Commissioner for State Excise, Maharashtra State, Mumbai on 10.07.2018. It is also not in dispute that the said Appeal has been heard by the Hon'ble Commissioner for State Excise on 13.08.2018 and the matter is closed for orders. Since the Appeal is heard by the Hon'ble Commissioner for State Excise, Maharashtra State, Mumbai and is pending for orders, it would not be appropriate to consider this

WP 8322-18.doc Petition on merits at this stage. Accordingly, the aforesaid Petition can be disposed of by the following order.

O R D E R (i) The Hon'ble Commissioner for State Excise, Maharashtra State, Mumbai to dispose of Commissioner Appeal No. 184 of 2018, by passing appropriate orders, within one week from today;

(ii) It is made clear, that this Petition has not been considered on merits.

The Petition is disposed of in the aforesaid terms. All concerned to act on the authenticated copy of this order.
