1] Learned counsel for the Appellant, on instructions, submits that the parties have settled the dispute amicably between them and as a result thereof, they have withdrawn the suit filed before the trial Court. Therefore, the Appellant wants to withdraw the Appeal.

2] It is further submits that the amount which was arrived at as a result of the settlement has been already paid and it is recorded in the order of the trial Court.

4] Refund of Court fees, if any, is allowed.

5] The amount of Rs.25,000/- which was deposited by the Appellant in the Court at the time of filing of the First Appeal also be refunded to him.
