Learned APP submits that during the pendency of this applicant and without withdrawing the present application, the applicant has filed an application seeking enlargement on bail before the Sessions Court, which is registered as Criminal Application No. 81 of 2018 in Crime No. 65 of 2018 registered at Khopoli Police Station. The said application is pending before the Sessions Court at Alibag, Raigad. In fact, it was incumbent upon the applicant to withdraw the present application before he approached the Sessions Court. The application of the applicant is rejected by the Ad-hoc Additional Sessions Judge, Raigad Alibag on 29/6/2018 and the charge-sheet has been filed on 25/7/2018. Talwalkar

The learned Counsel for the applicant without assigning any reason upon instructions seeks leave to withdraw the application. Liberty as prayed for is granted in the interest of justice. The application stands dismissed as withdrawn and disposed of accordingly.
