Petitioners i.e. husband and mother-in-law of Respondent No.2 have filed present Petition for quashing of CR No.242 of 2022 registered with Mulund Police Station, Mumbai under Section 498-A, 406, 377, 504, 323 and 506 read with Section 34 of the IPC, with the consent of Respondent No.2. 2.
Learned Advocate for the Petitioner submitted that, the Petitioners and Respondent No.2 have executed Consent Terms dated 12th July 2022 in ABA No.721 of 2022 before the Hon' ble Sessions Court at Mumbai. In paragraph No.6 thereof, the Respondent No.2 has given her 'no objection' for quashing of C.R. 1/2
NSK 91-wp-3320-2022 No.242 of 2022 registered with Mulund Police Station. In furtherance of the Consent Terms dated 12th July 2022, present Petition is filed for the quashing of the said crime. 3.
Learned Advocate for Respondent No.2 tendered across the bar, an Affidavit of Respondent No.2 dated 18th May 2023, duly affirmed before the Justice of the Peace of Victoria, Melbourne, Australia. In paragraph No.5 thereof, the Respondent No.2 has given her 'no objection' for quashing of the crime in question. Learned Advocate for Respondent No.2, on instructions from Respondent No.2, reiterates the contents of her Affidavit dated 18th May 2023 and her 'no objection' in quashing of the crime in question.

In view of the above, Petition is allowed in terms of prayer Clause (a).
