Heard Mr. Nighot, learned Counsel for the applicant and Ms Kapre, learned Counsel for the respondents. 2.

The matter was heard on 23.08.2018. Mr. Kapre had tendered certified copy of the compromise purshis dated 03.01.2017 at exhibit-130 filed in the Court of Small Causes at Pune in Darkhast No.133 of 2006. As the matter is amicably settled between the parties, on instructions from the son of the applicant - Mr. Hassan Gulam Tafti, who is present in the Court, Mr. Nighot seeks permission to withdraw this Petition. Mr. Nighot submits that the Executing Court has fixed the matter on 11.09.2018. He submitted that the Architect has submitted report in December, 2017 and the applicant is agreeable to the proposed division suggested by the Architect. 1/2

Ms Kapre assures that the respondents will extend full co-operation for implementing the compromise terms between the parties.

In view thereof, on the oral application made by Mr.Nighot, C.R.A. is allowed to be withdrawn and is disposed of as such. Order accordingly.
