The applicant had preferred this application seeking prearrest bail in C.R. No. 520 of 2021 registered with Dongri Police Station for the offence under Sections 395, 384, 342, 365, 323, 504, 506 read with 34 of the Indian Penal Code. 2.
It was alleged that the workers and the complainant were carrying meat from their vehicles to crawford market. The vehicle was stopped by the accused and the persons carrying the meat were assaulted. The accused also demanded money. Both the parties are known to each other. They have settled the matter. Although the offence under sections 395, 384 of IPC
Ethape 2 30-ABA-2255-2021 were invoked this is a peculiar case. Consent terms are executed by both the parties which are tendered in Court. It is mentioned that, the dispute is amicably settled between parties. The complainant is present in the Court. Parties would move application for quashing the proceeding before this Court. The consent terms are taken on record. Learned counsel for the complainant submitted that the complainant has no objection for allowing this application.
ORDER
(i) Anticipatory Bail Application No.2255 of 2021 is allowed.
(ii) In the event of arrest of the applicant in C.R. No.520 of 2021 registered with Dongri Police Station, the applicant be released on bail on executing PR bon in the sum of Rs. 25,000/- with one or more sureties in the like amount;
(iii) Leave to amend to prayer clause and consent terms to correct the correct Crime Number. Amendment may be carried out forth with.
(iv) Application stands disposed of.
