Learned Counsel for the parties are agreed that the matter would be covered by the order dated 13 September 2006 passed by the Division Bench of this Court in connected Writ Petition No.5434 of 2000 wherein the following order was passed:
"1.
In view of the law laid down by the Constitution Bench of the Apex Court in the case of Steel Authority of India Limited & Ors. v/s. National Union - Waterfront Workers & Ors., 2001 III CLR 349, this petition does not survive any further and the petitioners will have to resort to the remedy as laid down by the Apex Court in the aforesaid case of Steel Authority of India Limited & Ors. (Supra). Petition is therefore dismissed.
Protection granted by this Court shall be operative for a further period of four weeks from today."
k 2/2 206 wp 1906.99 as.doc Accordingly, the Petition is disposed of by granting liberty to the Petitioners to resort to the remedy as laid down by the Apex Court in the case of Steel Authority of India Limited & Ors. The protection granted by this Court shall continue to operate for a further period of eight weeks from today.
