Leave to amend the cause title is granted. The amendment should be carried out forthwith.

On hearing the learned counsel for the parties and on perusal of the Judgment of the reference Court, the Judgment of the reference Court is stayed during the pendency of the First appeal, on the condition that the appellant deposits the entire amount payable in terms of the Award of the reference Court, in the reference Court, within a period of twelve weeks. If the amount is so deposited, the respondent is permitted to withdraw 75 per cent of the amount on furnishing solvent surety / security to the satisfaction of the reference Court.

20 CA 4105-14 in FA 1398-14.doc The balance amount should be placed in a fixed deposit account of a nationalised Bank during the pendency of the First appeal.

Civil application is allowed in the aforesaid terms and disposed of.
