The learned AGP on instructions states that the record of the Appeal preferred by the petitioner before the State Government (bearing No.RTS 691/3010 (L-6) was destroyed in the fire in Mantralaya and now the record of the appeal has been reconstructed.

He states that the appeal is still pending. Considering the fact that the appeal is pending from the year 2010 and considering the fact that the appellant suffers from permanent disability, out of turn priority deserves to be given to the hearing of the appeal.

wp10675.doc We direct that the aforesaid appeal shall be disposed of as expeditiously as possible and in any event within a period two months from the date on which this order is uploaded.

To enable the Appellate Authority to fix the date for hearing, we direct the petitioner or his authorised representative to remain present on 7th September 2018 at 3.00 p.m. Writ Petition is disposed of.

All contentions on merits are kept open.

The appeal shall be disposed of on its own merits.
