The Notice issued to Respondent No.1a is received unserved with remark "Respondent No.1a sold premises since 3 years back, present address not known, hence pasted". Respondent No.1a herein was Defendant No.1a in the suit before City Civil Court, Mumbai and had appeared and was served on same address.

She has changed her address now. Hence, it is evident that Respondent No.1a cannot be served by regular mode of service.

Hence, there is no other way to serve

Respondent No.1a except by way of Publication of Notice in local Newspapers as mentioned in prayer clause of Civil Application.

In view of this, Civil Application is allowed in terms of prayer clause (a). Issue Publication Notice to Respondent No.1a returnable after 8 weeks.
