In view of the statement made by the learned A.P.P, learned Counsel for the applicant seeks leave to withdraw this application, with liberty to file an appropriate application before the Sessions Court, after filing of the charge-sheet.

Accordingly, the application is disposed of as withdrawn, with liberty as prayed.

It is made clear that if an application is filed after filing of the charge-sheet, the same shall be decided by the learned Judge, on its own merits, uninfluenced by the withdrawal of this application. 5.

In view of the above order, nothing survives for consideration in the intervention application being Criminal Application No. 688 of 2017. The same stands disposed of.
