Heard learned counsel for the petitioner and learned A.P.P. for the State and learned counsel for CBI.

The petitioner is one of the accused in Special Case No. 42 of 2014 along with 10 of 2015 filed by the CBI against the applicant and others. The prayer is for staying the further proceedings in both the special cases on the ground that further instigation is in progress. 4.
The prayer is opposed by learned A.P.P. It is submitted that further investigation is in progress in respect of the amount deposited in foreign bank by the applicant. Local investigation is completed.

It is sufficient to mention here that further investigation by itself cannot be a reason for staying the trial. Strictly speaking further investigation in any case can continue even after filing of the chargesheet. In the present case, if some evidence is found against the applicant after further investigation, the respondent will file supplementary chargesheet and additional evidence can be recorded. Continuance of trial for the time being will not in any manner prejudice the applicant. The application is rejected accordingly.
