The petitioner had sought only relief in this petition is to expedite the hearing or Criminal Revision Application No. 299 of 2017 pending before the Sessions Court at Dindoshi, Mumbai. The petitioner is the original complainant in private complaint No. 85/SW/2016 pending before the learned Magistrate Court 67, Borivali. The complaint is filed for an offences punishable under Sections 504, 506(ii), 323, 324, 325 r/w 120 (b) of Indian Penal Code. The order of process is challenged by the Respondents by preferring Criminal Revision Application No. 299 of 2017 before the Sessions Court. The learned Additional Sessions Judge has granted interim stay to the proceedings in Criminal Case No.

Sknair 37-wp-3075-18.odt 85/SW/2016 by order dated 25th April, 2018. Learned counsel for the petitioner submits that the petitioner is a senior citizen aged about 68 years. The complaint was filed in the year 2016 and thereafter the process was issued on 24th August, 2017. Learned counsel for the petitioner placed reliance on the decision of Hon'ble Supreme Court in the case of Asian Resurfacing of Road Agency Pvt. Ltd. & Anr. -Vs- Central Bureau of Investigation1 in support of his submissions.

Considering the submissions advanced by the counsel for the applicant, the Sessions Court at Dindoshi, Mumbai is directed to decide the Criminal Revision Application No. 299 of 2017 within a period of six months from today.

The revisional Court shall decide the Criminal Revision Application in accordance with law.

The Writ Petition stands disposed off.
