The learned Counsel for the applicant, pursuant to an order dated 21st October, 2016 passed in Criminal Application No. 859 of 2016 in Anticipatory Bail Application No. 1304 of

* 8/8 * 2016 makes a prayer for similar relief as according to them the case of the applicants is similar.

In view of above statement which is not seriously disputed by the other side, relief as is provided in the order dated 21st October, 2016 can be extended to the applicants. In view thereof, in my opinion, it will be appropriate to pass the following order :- 3).

The applicants shall prefer an application, if not already preferred, under Section 70 sub-section (2) read with Section 88 of the Criminal Procedure Code before the Special Court on 5th December, 2016.

If such applications are filed, the Special Judge shall decide the same on the same day or any other day which is convenient to the said Court provided the delay is not attributable to the applicants. The Judge, if prefers to defer hearing on his own, he may continue the interim relief ordered herein.

5).

With the above observations, the present applications are disposed off as withdrawn. The interim protection ordered herein shall continue till 5th December, 2016. 6).

In case if the Special Judge decides to pass an order adverse to the interest of the applicants, the same be not given effect to for a period of two weeks.
