The learned counsel for the applicant states that in view of the pendency of the appeal before Division Bench of this Court assailing the order of discharging the applicant from accusation of having committed offence is under MCOC and ULP, but the said order being stayed by virtue of the interim stay granted by this Court, the applicant intends to press the application at later stage and seeking leave to withdraw the application with liberty to file it at later stage as advised. Since withdrawal is a choice of the parties and considering the circumstances in which the withdrawal is sought, the application is disposed of as withdrawn with liberty to renew the prayer for bail at the proper stage.
