Ms Mittal, learned Advocate appearing for New India Assurance Co. Ltd states that she has instructions to withdraw the Appeal and she submits that the entire amount has been deposited in the Tribunal out of which 50% is withdrawn by the Respondent. Appeal is allowed to be withdrawn and hence disposed as withdrawn.

Statutory amount, if any, deposited in this court to be transferred to the Tribunal at Thane along with accrued interest. 3.

Respondents-claimants will be at liberty to withdraw the entire amount with accrued interest deposited by the Insurance company. 4.

Appellant is entitled to refund of court fees as per applicable rules. 5.
