3. Considering the submission made by the Learned Counsel for the Applicant and the reasons disclosed in Para.7 of the Civil Application, I am satisfied that the Applicant has made out a case for allowing this Civil Application. Hence, the following order:

b. Order dated 28/06/2019 passed by this Court be recalled.

c. Misc. Civil Application No. 28/2019 is restored for hearing on its own merits.

d. The Applicant is directed to inform the other side about the restoration of matter in writing.

e. Misc. Civil Application No. 28/2019 to appear on board for hearing on 11/11/2019.
